Key Facts About Deposit Protection

Essential rules every landlord in England & Wales must follow under the Housing Act 2004.

30-Day Rule

You must protect a tenant's deposit in a government-approved scheme within 30 days of receiving it. The clock starts the day the money is received.

Prescribed Information

Protecting the deposit alone isn't enough. You must also serve the Prescribed Information to the tenant within the same 30-day window.

Penalty: 1x–3x Deposit

If you fail to protect or serve the PI, a court can order you to pay the tenant between 1x and 3x the deposit amount in compensation.

Section 21 Blocked

You cannot serve a valid Section 21 notice to end an assured shorthold tenancy if the deposit is not properly protected and PI served.

Applies to Renewals

When a fixed-term tenancy becomes periodic (rolling), the deposit protection must remain in place. Re-protecting may be needed if the tenancy terms change.

Housing Act 2004

Deposit protection requirements were introduced by the Housing Act 2004 (sections 212–215) and apply to all assured shorthold tenancies in England and Wales.
